Access to nursing home patients; purposes; requirements; termination of visit; confidentiality; complaint; determination; prohibited entry

 

Nursing homes must allow authorized representatives of approved organizations, family members, and legal representatives access to nursing home patients in order to provide personal, social, and legal services, to inform patients of rights and entitlements, and to assist patients in asserting such rights and entitlements. All visitors must have the patient’s consent to visit, provide identification upon their arrival, and make their visit during the nursing home’s visiting hours. A patient may end a visit by an individual granted access, and all of the patient’s communications with such individuals are confidential. Nursing home administrators or employees that suspect a visitor is “acting or has acted in a manner detrimental to the health and safety of patients in the nursing home” may make a complaint to the Task Force.
