A health facility or health care center must post a policy describing the rights and responsibilities of patients in a public place. The policy describing the rights and responsibilities of the patients should include at the minimum the following:
- A patient should not be denied care based on race, religion, national origin, sex, age, disability, marital status, sexual preference or source of payment.
- A patient has a right to inspect or receive at a reasonable fee, a copy of his or her medical record.
- A patient has the right to confidential treatment of his or her personal and medical records.
- A patient has a right to privacy in his or her treatment and for his or her personal needs.
- A patient is entitled to receive adequate and appropriate care and receive information about his or her condition, treatment, and recovery in a way that is easily understandable to the patient.
- A patient has the right to refuse treatment as long as he has been informed about the results of not having treatment.
- A patient is entitled to voice his grievances or recommend policy changes. The patient has a right to access information regarding the facility’s policies and procedures to initiate a complaint.
- A patient has the right to get information on experimental treatments that are proposed and has the right to refuse such treatments.
- A patient is entitled to receive and review his or her bill and must receive an explanation of the bill upon request, regardless of the source of payment.
- A patient has the right to know the person responsible for his or her direct care.
- A patient has the right to have private communications with his or her physician, attorney, or any other person. This right to privacy extends to receiving mail, which should be unopened. The patient’s religious freedoms must be preserved, so he or she is free to practice his or her religion.
- A patient shall not be mentally or physically abused and should be free from physical or chemical restraints, unless authorized by the patient’s physician for a limited time or if necessary to protect the patient from injury or to protect others from injury.
- The patient is not to perform services for the hospital or health facility that are not part of his or her treatment plan.
- The patient is entitled to information about the health facility and its policies regarding patient care and conduct.
- The patient must receive appropriate pain and symptom management as part of his or her medical treatment.
