Individuals must have a license in order to carry a concealed pistol. They may obtain a license by filing an application with the clerk of court located in their county of residence. The application requires individuals provide information such as references, past criminal convictions, and other law violations. Applicants must additionally authorize the concealed weapon licensing board to access any of the individual’s records relevant to their capacity to carry a concealed pistol including their medical and mental health records. Applicants may request that the weapon licensing board consider their records during a closed session and have a right to attend this session. The weapons licensing board must keep all medical and mental health record information confidential and such information is not subject to the freedom of information act. However, the weapons licensing board may release medical record and mental health record information for law enforcement purposes and may release medical record information if an “applicant is convicted of a felony involving a pistol.”
