The Department must maintain the confidentiality of all reported birth defects and may not disclose any information containing identifiable information. Such identifiable information may only be disclosed if requested by the patient, requested by the patient’s parent if the patient is a minor, or requested by an attorney of the patient. All written requests for disclosure of such information must contain a witness’ signature or be notarized. Identifiable information may also be released to those individuals conducting studies approved by the scientific advisory panel; however, if the study requires contact with the patient, the patient or the patient’s parent must approve of their inclusion in the study before such information may be disclosed.
