Long-Term Facility Resident Rights - Mo. Code Regs. Ann. tit. 19, § 30-88.010

Long term care facilities must inform all residents, next of kin, or legally authorized representative of their rights and responsibilities as residents in the facility. This information must also be posted conspicuously in the facility. The resident and/or his or her next of kin or representative also have a right to be informed of all charged imposed by the facility and the facility’s treatment policy and end of life care. The facility is also required to provide the resident, his or her next of kin, or personal representative an itemized statement of charges upon discharge or death. The physician must also inform the resident of his or her own health care, and allow the resident to take an active role in his or her treatment. Residents must be allowed to exercise their rights, such as right to speech, association, and religion, and also be allowed to voice their grievances. The long term care facility must also develop policies that prohibit the maltreatment, abuse, or neglect of any resident, and require reporting to the Department of Health and Senior Services should such conduct occur. Residents’ personal and financial health records must be kept confidential.
