Physicians must retain patient records for 10 years. A physician may designate an entity, other physician or health care facility provided that the designee stores the record in a manner that preserves confidentiality and allows lawful access.
Records may be stored electronically or via microfilm or other similar means. Original paper records may be destroyed if records are stored in this manner, provided the record could be reproduced identical to the original.
Electronically stored records must identify original documents or information not included in the electronic record.
