Records confidential
All substance abuse treatment records are confidential and privileged to the patient and may only be disclosed according to the statute. The statute does not address disclosure with consent or disclosure pursuant to court order. Disclosure of substance abuse treatment records is permitted in two circumstances: first, the director may disclose patient records for research purposes provided that patient identifying information is not published, and second, confidential information may be disclosed in a medical emergency.
