Licensed hospitals and their insurance carriers must create an “internal risk management program” that: (1) has an in-hospital process for addressing grievances and complaints; (2) requires the continuous collection of adverse outcome and malpractice data (e.g. grievances, award amounts, liability insurance premiums); (3) utilizes “medical care evaluation mechanisms” (e.g. tissue committees, medical audit committees) to assess the appropriateness or quality of care; and (4) provides education on patient safety and other topics associated with malpractice reduction to hospital staff.
