Ind. Code Ann. § 16-39-2-2 - Maintenace of records by providers of mental health services

This law requires that a provider maintain a record for each patient receiving mental health services, and that the record contain all the information that the division of mental health and addiction, division of disability and rehabilitative service or state department of health require.
The law further states that the provider is the owner of the mental health record, is responsible for its safekeeping, and is entitled to retain possession of the record. The law clarifies that the patient also owns the information contained in the mental health record and the provider is required to maintain the original mental health record or a microfilm of the record for at least 7 years.
