Incident Reporting Procedures for the Office of Mental Health and Office for People with Developmental Disabilities – N.Y. Mental Hyg. Law § 29.29

The office of mental health and office for people with developmental disabilities must create policies and procedures for reporting incidents that jeopardize the welfare of patients at a facility. These procedures must include (1) the creation of a “patient care and safety team” at each facility; (2) the maintenance of incidence records that include the names of the patients and employees involved; (3) “a compilation of uniform and measurable information, first on a facility basis, then on an office-wide basis, that will indicate where the greatest number and types of incidents occur;” (4) the requirement that each facility aggregate its monthly data for semiannual submission to the applicable commissioner; and (5) the requirement that the commissioners forward these data reports to “the state commission on quality of care and advocacy for persons with disabilities.”
