All licensed health care facilities that receive a report of abuse or neglect must immediately report the incident to the Adult Protective Services Division. All abuse and neglect reports must be submitted within 24 hours. All reports must comply with the Division incident report and CMS regulations and must be submitted by the reporter with direct knowledge of the incident. All reporters of abuse or neglect incidents are free from retaliation, unless the report was made with false intent. The health care facility must maintain a quality improvement system to allow for corrective measures to be taken following all reports of abuse or neglect.
