Incident management system reporting requirements for community-based service providers-N.M. Code R. § 7.1.14.8

All community-based service providers, their employees, and volunteers have a duty to report all incidents of abuse or neglect to the Department of Health Improvement hotline. Community-based service providers must also report the incident on the Division’s abuse and neglect form. The provider may not investigate the incident beyond what is necessary to report the incident until after the conclusion of the Division’s investigation. The community-based provider must preserve all evidence of the incident and must notify the legal guardian or parent of the patient abused or neglected. Those individuals that report incidents of abuse or neglect may not be retaliated against so long as the report was free from false intent. Community-based providers must also maintain a quality improvement program to enact corrective actions following the conclusion of investigations.
