Idaho Code Ann. § 39-1393, Notification of Professional Review Action Imposed upon Physician or Emergency Medical Services Personnel

Requires health care organizations to report actions taken against licensed physicians or emergency medical services personnel to the Board of Medicine. Specifies the information that such organizations must include in their initial report (e.g., a statement regarding the concerns that prompted the investigation) as well as the information they must include when prompted by the Board (e.g., a statement regarding the specific concerns that led to the sanctions, patient records from the reported physician, etc.). Clarifies that the Board may not obtain peer review records. Requires health care organizations to submit records voluntarily. Permits the Board to seek a court order to compel production of the records if the organization refuses to comply. Establishes immunity to liability arising out of compliance with the notification requirements so long as the party acted in good faith.
