Idaho Code Ann. § 37-2726, Filing Prescriptions — Database

Requires persons that dispense controlled substances and opioid antagonists to electronically report the dispensing to the Board of Pharmacy (“Board”). Requires the Board to create a controlled substances database and to retain prescription reports for five years following the date of dispensing. Identifies the persons that may receive information from the database (e.g., law enforcement agencies that enforce controlled substances laws, practitioners licensed to prescribe controlled substances, prosecutors, etc.). Requires the Board to keep records of information releases. Establishes penalties for persons that improperly access or disclose information from the database (e.g., 6 months imprisonment and/or a maximum $2,000 fine).
