Idaho Admin. Code r. 18.04.10.082, Prohibition Against Use of Genetic Information and Requests for Genetic Testing

Prohibits insurance carriers that issue Medicare supplement coverage from using an individual’s genetic information as the basis to deny or limit coverage or set prices for coverage. Clarifies that carries may take these actions based on the manifestation of a genetic disease or disorder unless constrained by other laws. Prohibits carriers of Medicare supplement coverage from requiring an individual or their family member to undergo genetic testing. Clarifies that health carriers may obtain and use genetic test results for payment determinations in accordance with HIPAA, but limits the information they may obtain to the minimum amount necessary. Permits carries of Medicare supplement coverage from requesting that an individual or their family undergo genetic testing so long as the test is for research and the carrier complies with other requirements regarding items such as notice and limits on the use of the test information.
