Hospitals must include at least two home health care agency options in a discharge plan when recommending that the patient receive home health care. Hospitals that have ownership or investment interests in home health care agencies or receive compensation for referring patients to home health care agencies must disclose these interests to patients before using the agency in the patient’s discharge plan. Hospitals may satisfy this disclosure requirement verbally or through notice “posted in a conspicuous place visible to patients.”
