The Commissioner of Social Services must apply for a Medicaid waiver in order to provide community and home based services to a maximum of 100 Medicaid eligible persons living with HIV/Aids. If the Commissioner does not apply for the Medicaid waiver by February 1, 2010, they must submit a report to the General Assembly that describes their reasons for, and the fiscal implications of, not submitting the waiver application.
