Health care providers, prior to ordering an HIV test, must provide patients or their authorized decision maker with information about HIV, testing positive for HIV, and their ability to ask questions about or decline testing. Arizona exempts providers from compliance with this requirement in multiple circumstances. These circumstances include testing human tissue prior to research or transplantation, testing requested by a provider or first responder that was exposed to a patient’s blood or bodily fluids while performing their occupational duties, and testing that is necessary to diagnose or treat a patient that requires emergency treatment and is unable to consent. The attending physician present during such emergency treatment must document that an emergency occurred, an HIV test was necessary to diagnosing or treating the condition, and the patient could not consent.
