A health care provider may not knowingly make a false statement or misrepresentation of a material fact in an application for payment by the Medicaid program. Similarly, a provider may not misrepresent a material fact in an application to determine a person’s eligibility for benefits under Medicaid. False statements by a provider for payment or eligibility are punishable if they are made with the intent to garner a higher payment than is due.
