The Department of Health has the authority to suspend, revoke, or cancel any agreement with a provider if the provider has committed an act of fraud or abuse under a medical assistance program. A provider or employer may report to the Department the names of providers who have or are engaging in fraud and abuse, but those names must remain confidential, and the reporter’s name must remain undisclosed. The Department also has the authority to review all claims and records to determine if there has been overutilization.
