“Discipline under the regulation of professions and occupations law”
The Board of Clinical Social Work may deny a license or impose disciplinary sanctions of a licensed mental health professional for a variety of grounds including:
- Paying or receiving any commission, bonus, kickback, or rebate or engaging in any split-fee arrangement with another health care professional or entity for patient referrals;
- Making or filing a false report or failing to comply with reporting requirements;
- Engaging in sexual misconduct with a patient;
- Making deceptive representations;
- Failing to make copies of tests and records available to a patient upon written request;
- Being unable to work as a licensed mental health professional as a result of an illness or substance use;
- Performing any experiments on patients without first obtaining the patients’ written, informed consent; and
- Violating patient confidentiality.
