Engaging in Open Discussion
Permits health care providers and facilities to engage in an open discussion with a patient following an adverse health care incident. Requires providers to send the patient notice of their desire have an open discussion. This notice must inform the patient of their right to obtain legal representation, their right to access relevant medical records and to authorize the release of these records to a third party, and that the substance of such a discussion is confidential, privileged, and not admissible in subsequent legal proceedings.
