Disclosure of records
Classifies the Department of Health’s disease control records as confidential. Defines these records as including all information, reports, notes, and data collected by the Department— or other individuals or entities working with the Department— in order to control disease or reduce harm from a health condition. Prohibits Department employees from being questioned in judicial, legislative, or administrative proceedings about the existence of disease control reports or information therein. Prohibits the disclosure of disease control information unless disclosure occurs in one of the specified exceptions. Permits disclosure to the person that is the subject matter of the record so long as the other individuals are not identified. Permits disclosure of information for research purposes so long as the researcher meets specified standards (e.g., has proper sponsorship, establishes security protocols, agrees to comply with use limitations, etc.).
