Before providing telemedicine services, a health care provider must obtain the patient’s informed consent either verbally or in writing. Verbal informed consent must be documented in the patient’s medical record.
Arizona classifies all medical reports generated from a telemedicine encounter as part of the patient’s medical record. Telemedicine encounters are confidential. Providers must obtain a patient’s consent prior to disclosing images or identifiable information for research or educational purposes unless a federal or state law authorizes disclosure without consent.
The informed consent requirements regarding consent for telemedicine and consent for the disclosure of information do not apply if the telemedicine encounter does not occur in the patient’s physical presence, a patient or their decision maker cannot give informed consent due to an emergency situation, or when the provider transmits diagnostic images to a consulting provider.
