Health insurers must maintain strict confidentiality regarding HIV test results. Information regarding HIV test results may not be disclosed to third parties except as provided for in this statute and DEL. CODE ANN. tit. 18, § 7405. A health insurer may disclose an applicant’s HIV test results to its reinsurers or to business associates such as contractually retained medical personnel and insurance affiliates, excluding agents and brokers, which are involved in underwriting or claims decisions regarding the individual’s application.
