Any person who commits any of these acts will be subject to the following: 55 Pa. Code, Chapter 1101, “Criminal penalties” 55 Pa. Code § 1101.76
- For the first offense, the provider will be guilty of a third degree felony, punishable by a fine of $15,000 and seven years imprisonment;
- For subsequent offenses, the provider will be guilty of a second degree felony, punishable by a fine of $25,000 and ten years imprisonment.
- For every offense, the convicted provider must repay the amount of excess benefits or payments, plus interest, and may be required to pay up to three times the amount of excess benefits or payments.
- The convicted provider may not participate in the medical assistance program for five years from the date of conviction.
