“Content of disclosure authorization forms”
Insurance institutions, insurance producers, and insurance support organizations (“Insurers”) that wish to disclose personal or privileged information during an insurance transaction must obtain an individual’s authorization on a form that is dated and written in plain language. The form must identify the types of persons that may disclose information, the type of information these persons may disclose, the recipient of the information, and the purposes for which data is collected. Forms that authorize insurers to collect information in connection with the processing of insurance applications, policy reinstatements, or benefit changes must state the duration of the authorization’s validity. This duration may not exceed 30 days for life, heath, or disability insurance. Forms that authorize the collection of information in connection with the processing of claims must state the duration of the authorization’s validity. For health policies, this duration may not exceed the length of the policy’s coverage. All forms must notify individuals of their entitlement to a copy of the authorization form.
