The Department must comply with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) when maintaining the confidentiality of all reported abuse and neglect information. Such information is not available as a public record until the conclusion of all investigations and hearings. However, no identifying information may be released. If, at the conclusion of an investigation and hearing, the report is unsubstantiated, it may not be released as a public record.
