Confidentiality of Client Information 
 
Requires mental health and substance abuse programs to maintain the confidentiality of information regarding clients and former clients. Prohibits disclosure of the information unless disclosure occurs in specified circumstances (e.g., with a client’s consent, pursuant to 42 CFR Part 2, when necessary to report child or adult abuse, etc.). Requires programs to obtain clients’ written consent before billing third parties or seeking delinquent payments. Prohibits a program’s governing board from accessing confidential client information unless access is necessary to deal with a client grievance. Requires staff members that have access to client records to comply with all applicable federal, state, and local confidentiality laws and regulations.
