Compulsory Process
Specifies the circumstances in which a hospital may disclose health care information pursuant to a court order or during discovery (e.g., the patient consents to the disclosure, the patient is a party to proceeding and their physical or mental condition is at issue, a court determines that the interest in admission of the information outweighs the patient’s privacy interest, etc.). Requires the party seeking to admit or discover a patient’s health care information to notify the patient at least 10 days prior to serving the hospital with a certificate to obtain health care information.
