Complaint Process
Requires accredited providers of DD waiver services to comply with accreditation requirements regarding grievances and complaints. Requires providers to establish policies and procedures for resolving, documenting, and reporting complaints. Permits persons to file complaints with the Behavioral Health Division verbally or in writing. Requires providers to file complaints in writing unless the complaint pertains to a participant whose health or safety is at risk. Requires the Division to investigate and resolve the complaint. Permits the Division to create a corrective action plan as part of the resolution. Imposes sanctions on providers that fail to comply with the corrective action plan.
