Maine law holds any person, organization or entity liable for presenting a false claim for payment to the Department of Human Services for medical services under the Medicaid program.  The law also assigns liability for fraudulent claims, false statements, or false documentation submitted to the Department to defraud the Department.  Such action may subject the individual or entity to civil liability and restitution of the excess benefits, interest on the overpayment, payment of civil penalties, costs of the lawsuit, costs of the investigation, and attorneys’ fees.
