Free standing surgical centers must maintain medical records in a manner that protects the records from loss, damage, and unauthorized use. The medical records must contain patient identifying information, information on the patient’s medical history and the treatment provided, and the patient’s written informed consent.
Free standing surgical centers must retain medical records for 5 years after the date of last treatment. In the case of minor patients, medical records must be retained for 5 years past the minor’s 18th birthday. Facilities must notify patients whose records are to be destroyed prior to the destruction of the records.
