12-4 Vt. Code R. 205:5 - Requirements for operation of a home health agency under the Agency of Human Services regulations

“Requirements for operation under the Agency of Human Services regulations”
A home health agency must not discriminate based on age, sex, race, sexual orientation, country of origin, disability, source of payment, geography, or any other basis specified by law.
A home health agency must report any suspicion of abuse, neglect or exploitation to the Department of Disabilities, Aging and Independent Living Division of Licensing and Protection’s Adult Protective Services unit within 48 hours.
A home health agency must report the following critical incidents to the Department of Disabilities, Aging and Independent Living Division of Licensing and Protection:
- Any unexpected death;
- Loss of limb or function occurring during the provision of home health services;
- Any serious injury occurring during the provision of home health services including medication errors, and use of medical devices or restraints;
- Any patient suicide; or
- Any poisoning.
A home health agency must inform each client in writing of their right to contact and receive assistance from the state long-term care ombudsman. The notice must include the address and telephone number for the local long-term care ombudsman. A home health agency must ensure that the long-term care ombudsman or health care ombudsman has appropriate access to review clinical records of a patient.
