All documents concerning individuals receiving mental health services must be kept confidential. Documents may be released or disclosed under the following circumstances:
- With the individual’s written consent;
- To those engaged in providing treatment for the person;
- To the county administrator;
- To a court in the course of legal proceedings; and
- Pursuant to federal rules, statutes and regulations governing disclosure of patient information where treatment is provided by a federal agency.
Privileged communications, whether written or oral, may not be disclosed to anyone without written consent. Clinical and statistical data can be collected as long as the use and dissemination of such data does not identify individual patients.
