Antitrust in New Hampshire
A health insurer must not engage in any unfair method of competition or an unfair or deceptive act or practice.1 The insurance commissioner has the authority to investigate a health insurer to determine whether it engaged in an unfair method of competition or any unfair or deceptive act or practice.2 If a health insurer is found to have committed an unfair method of competition or an unfair or deceptive act or practice, its license may be suspended, revoked, or not renewed or penalized up to $2,500 for each violation.3 An individual or health insurer who was adversely affected by the health insurer’s actions may commence a lawsuit for damages.4
