This law allows the DHS, upon its discretion, to provide a requesting person access to data compilations or special reports based on health information collected by the DHS. The law allows DHS to establish fees for provision of these compilations and reports to cover the actual and direct costs of providing these services.
Entities contracted by DHS to collect and analyze health care information have the exclusive right to use and to provide a requesting person with access to data compilations and reports that they create, unless the entity’s contract with DHS prohibits it. Such entities must get DHS’s approval for the user fees they plan to charge requesters, and they get to retain all of the collected user fees.
