This law requires that DHS develop and implement a statewide trauma care system. DHS is required to develop a method to classify all hospitals with respect to their trauma care capabilities, and hospitals are required to submit various types of documentation to the DHS to support their classification levels. Confidential injury data that is collected for the purpose of classification must only be used for confidential review relating to improvement of trauma care system performance, and for no other purpose. None of this information submitted for performance improvement is subject to discovery and cannot be used as evidence or basis for a civil law suit.
