If an individual with long-term care coverage is residing in a long-term care facility and is hospitalized, their insurer must cover their return to the long-term care facility if:
- The individual’s physician determines that the facility can meet their medical needs.
- The facility is properly licensed, certified, and capable of readmitting the individual.
The facility is willing to accept payment at a rate that is similar to the rate negotiated between the carrier and other comparable facilities.
- The facility is willing to adhere to the standards and conditions regarding “utilization review, quality assurance,[] peer review” and management and administrative procedures that are found in contracts between the carrier and other comparable facilities.
