Washington requires all self-insured employers to provide their injured employees with access to the employee’s claim file within 15 days of the employee’s request unless the employer believes it is not in the employee’s best interests to obtain the file. If such an occasion arises, the employer “must submit a request for denial” that includes an explanation of the circumstances.
Self-insured employers must also provide any physician conducting an examination of the injured employee with all relevant medical records from the employee’s claim file.
Self-insured employers must include a medical report when they request that an employee’s claim be closed.
