Fraudulent practices — Penalties
Individuals or entities may not, by willful false statement, misrepresentation, or fraudulent act, obtain or attempt to obtain payments or benefits for medical services in excess of their entitled amount. Fraudulent acts include billing for nonexistent or subpar services or billing for covered services that are not actually covered.
Individuals or entities may be civilly liable for violations of this section even in the absence of a criminal proceeding and will be subject to civil penalties that, at maximum, equal three times the amount fraudulently obtained.
This section does not apply to persons receiving publicly funded health care benefits.
