Violations of chapter — Aggrieved persons — Right of action
Individuals harmed by another’s violation of Washington’s Sexually Transmitted Disease (STD) Control Laws may pursue an action for damages in civil court. The individual may obtain damages of $1,000 per negligent violation, $10, 000 per intentional violation, or, if greater, their actual damages.
This section does not limit the ability of an individual that was subject to an STD test to bring an action for relief under additional laws.
Washington does not impose civil or criminal liability on an individual that discloses the result of an STD test pursuant to federal disease reporting requirements.
The unauthorized communication of confidential STD information via fax or other means is a negligent violation if the sender knew or had reason to know the fax information was incorrect.
