Who are disqualified — Privileged communications
Washington privileges any communication between a patient and their physician or surgeon that occurred in relation to the patient’s treatment. Consequently, physicians or surgeons may not testify about such communication in a civil case. The privilege does not apply 90 days after an individual files a claim for personal injury or wrongful death or if the case involves the injury, neglect, or sexual abuse of a child.
