“Health care database under the health law”

The commissioner of Vermont health access must establish a unified health care database to enable the commissioner and the Green Mountain Care board to carry out their duties. The database must include a consumer health care price and quality information system designed to provide consumers with information related to health care prices, quality information, and other information that the commissioner determines is necessary to empower individuals to make economically sound and medically appropriate decisions.

The commissioner must convene a working group to advise on the development and implementation of the consumer health care price and quality information system. A health insurer covering at least 5% of the lives covered in the insured market in Vermont must file with the commissioner a consumer health care price and quality information plan. The commissioner must adopt rules to implement this statute. Records or information that is protected under physician-patient privilege and HIPAA is confidential and must be filed in a manner that does not disclose the identity of the protected person.

Any person who violates this statute must be penalized up to $1,000 per violation. The commission may impose a penalty of up to $10,000 for each violation that the commissioner finds were willful. Additionally, any person who violates confidentiality requirements may be fined up to $50,000 per violation.
