Requirements for records obtained related to fraud and abuse within the Medicare or the Medicaid programs
All records that are obtained in lieu of a fraud and abuse investigation shall be treated as confidential, investigative records of the office of the inspector general, and they shall not be available to the public. However, this section does not affect the obligation of a state agency acting under federal law to provide the medical fraud control unit with access to, and free copies of all records, information, or computerized data that is kept or stored by the agency.
No person shall be held liable for providing the office of inspector general with access to data as required by this chapter. In addition, this chapter does not require anyone to create a record that did not exist at the time of the request. However, no person may destroy data after being on notice that access to certain data is required for fraud and abuse investigations.
