Tenn. Code Ann. § 68-55-204 - Requirements for Reports to the Department of Health on Traumatic Brain Injuries

The Commissioner of Health has established a system for hospitals to report a patient with a traumatic brain injury to the Department of Health. Hospitals are required to report the following information to the system, and may do so without the patient’s consent:
- Name, age and residence of the injured person;
- Other information requested by the department that is in the patient’s hospital medical records.
Reported information is confidential and may only be used in accordance with rules promulgated by the commissioner.
A treating hospital that intentionally fails to comply with the reporting, confidentiality or disclosure requirements is subject to a fine up to $100 for the first violation and fines up to $5,000 for each subsequent violation.
