“State employees assistance program”
The employee assistance program refers state employees to medical, social or other services to providers of those services as needed.
Records of the identity, diagnosis, prognosis, or treatment of any person that are maintained in connection with the employee assistance program are not public records, and may only be disclosed without the individual’s consent in accordance with the following:
- To medical personnel to the extent necessary in a bona fide emergency;
- To qualified personnel for the purpose of conducting scientific research, management audits, financial audits, or program evaluation, if the personnel do not identify any person who is the subject of the record; and
- If authorized by a court, which must impose appropriate safeguards against unauthorized disclosure.
With the above exceptions, no record may be used to initiate or substantiate criminal charges against the subject of the records.
