A physician must maintain records for each patient and retain them for 3 years after last seeing the patient or 3 years after a minor patient reaches 18 years of age. A physician must provide to a patient or patient’s representative a copy of their medical record upon their request. Specifically, within 30 days, the physician must provide a summary of the record with the patient’s consent, or the physician may charge a reasonable fee for providing such records.
A physician may not disclose information related to a minor child to a parent, guardian or representative without the child’s consent if the disclosure is prohibited by law.
A physician may not abandon a patient once care has been undertaken without advance notice of the discontinuation such that the patient is able to obtain appropriate substitute care.
A physician may not willfully or recklessly disregard the health, safety, or welfare of a patient, and must conform to the prevailing standards of acceptable medical practice.
