Transfer of active patient records--Destruction--Notice
A licensed physician may only transfer active patient records in his or her control to another licensed health care provider, the patient or the patient's personal representative or designee, the patient's parent (if the patient is a minor), or a licensed health care facility,
Prior to transfer or destruction of active patient records, the physician must provide at least 30 days notice by mail to the patient, the patient's parent (if the patient is a minor), or the patient's personal representative at the patient's last known address. The notice must give the proposed date of transfer/destruction and give a deadline prior to which the records may be claimed.
