“Preexisting condition exclusion periods under the insurance law”
A health insurer offering health coverage to individuals, small employers, and large employers may impose a preexisting condition exclusion period that does not exceed 9 months.
Health insurers providing health coverage to large or small employers must not:
- Treat genetic information as a condition subject to a preexisting condition exclusion period in the absence of a diagnosis of the condition related to the genetic information; and
- Treat pregnancy as a preexisting condition.
